It’s Not Just Filling Forms…

The reason why you need an Immigration Attorney

By Akua Hanson-Kabu, Esq.

Whether you’re an immigrant looking to stay in the United States permanently or a non-immigrant visiting, attending school, or working, having an immigration lawyer by your side is key. One of the biggest misconceptions about immigration law is that it’s just about filling out forms and submitting them to the correct agency. While completing forms is part of the immigration process, it’s far from the whole picture. There’s no one-size-fits-all approach in immigration law. One of the most important things is having someone who can apply the correct legal principles to your specific situation and guide you in the right direction—whether it’s identifying the appropriate visa or determining if any forms of relief are available.”

Where there is authenticity, there are always counterfeits. Under the current administration, many migrants are experiencing fear and panic, prompting them to search for solutions. Unfortunately, some individuals seek to exploit this vulnerability for personal gain. These people may offer to file immigration forms for a fee while making promises they can’t legally keep. The issue isn’t with filing forms itself, but with the misleading advice that may come with it. It’s important to understand that anyone who is not a licensed attorney is prohibited from providing legal advice—including in the field of immigration.

What is legal advice?

Legal advice in the field of immigration can include, but is not limited to, the following:

  • Explaining the different immigration options available, such as visas, green cards, and other pathways
  • Assessing your eligibility and advising on the best course of action based on your specific situation
  • Accurately completing forms, gathering necessary documents, and ensuring compliance with all regulations and deadlines

Cesar Silva’s story is a powerful example of why having an immigration attorney on your journey is so important. In 1996, Mr. Silva came across an agency, in the United States, that claimed to offer immigration services, including securing work permits and legal residency for migrants. Driven by hope and a need for solutions, he walked into the agency. To gain his trust, they even arranged for him to speak with another client who had supposedly received their work permit. Unfortunately, the agency not only filled out his forms incorrectly but also swindled him out of $8,000. They applied for Temporary Protected Status (TPS) and falsely claimed that Mr. Silva was Nicaraguan, even though his documentation clearly showed he was from Mexico. As a result, he was placed in deportation proceedings. (Link to story for more.)

As an immigrant, it’s essential to take the necessary steps to verify that the person handling your case and offering legal counsel is authorized to do so. You can do this by asking whether they are a licensed attorney and performing a quick license lookup in the state where they claim to be licensed. Taking this simple precaution can protect you from potential harm or fraud. Even if your case seems straightforward and you’ve already completed the forms, it’s always wise to have an experienced immigration attorney review your documents. This ensures everything is accurate, complete, and ready for submission.

Navigating the immigration process can be complex and emotionally overwhelming—but you don’t have to do it alone. Misconceptions and misinformation can lead to costly mistakes, and unfortunately, there are individuals who may take advantage of those seeking help. That’s why it’s crucial to work with a licensed immigration attorney who can provide accurate legal advice tailored to your situation.

By taking the time to verify credentials and seek professional guidance, you’re not only protecting yourself but also giving your case the best possible chance for success. Remember, your future deserves more than guesswork—it deserves trusted, qualified support every step of the way.
